1. Introduction
These Terms of Service (“Terms”) govern access to and use of PivotDesk, including the website, software, templates, workflows, advisory services, and related materials we provide (together, the “Service”).
By purchasing, creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use PivotDesk.
In these Terms, “PivotDesk,” “we,” “us,” and “our” mean Whimsy OÜ, an Estonian company registered under number 17495721.
2. About PivotDesk
PivotDesk is a relationship-led job-search system for experienced professionals making a meaningful move that may make more sense in conversation than on paper. Depending on the offer you purchase, the Service may include software, structured workflows, target-list and contact-mapping tools, outreach and follow-up support, AI-assisted drafting and preparation features, educational materials, and limited direct advisory support.
2.1 What PivotDesk is designed to do
- Help users choose and rank target companies for one serious search direction.
- Help users map priority contacts and backups at target companies.
- Help users draft and send tailored outreach grounded in a real reason for contact.
- Help users schedule and manage follow-ups so opportunities do not go cold.
- Help users prepare for networking calls, informational conversations, and early interviews.
- Provide a structured 14-day activation process inside a limited access period.
2.2 What PivotDesk does not do
PivotDesk is not:
- a recruiting agency, headhunter, or placement firm,
- legal, tax, immigration, or financial advice,
- mental health care or therapy,
- a guarantee of interviews, offers, compensation, visa outcomes, or employment.
Any guidance, templates, prompts, or feedback you receive through PivotDesk are tools to support your decision-making. You remain responsible for your own job search, communications, and career decisions.
3. Eligibility
To use PivotDesk, you must be at least 18 years old, have the legal capacity to enter into a binding agreement, not be prohibited from using the Service under applicable law, and, if acting for an employer or other organization, have authority to bind that organization to these Terms.
4. Accounts and Access
You may need to create an account to access some or all of the Service. You agree to provide accurate information and keep it current.
You are responsible for maintaining the confidentiality of your login credentials and for activity under your account. Notify us promptly at [email protected] if you believe your account has been accessed without authorization.
Unless we expressly agree otherwise in writing, each purchase is for one individual user’s own search. You may not share your account or distribute paid materials to others.
PivotDesk is a one-time purchase, not a recurring subscription. Each offer includes 6 months of access from the date your access is activated, unless a different start date is clearly stated at checkout or onboarding.
After your 6-month access period ends, you may continue to view your existing data in PivotDesk but may not create new content or make changes within the system. Extension options and pricing will be communicated closer to your renewal window.
PivotDesk Advisor includes a short fit screen and is subject to limited capacity. Applying for or attempting to purchase Advisor does not guarantee acceptance. If we do not accept you into Advisor, we may decline the order or refund any Advisor payment collected, unless you agree to a different arrangement.
5. Offers, Pricing, Payment, and Taxes
At the time of this draft, PivotDesk offers:
PivotDesk Sprint
- Price: $150 USD one-time founding-cohort price
- Access: 6 months
- Type: Self-serve search system
PivotDesk Advisor
- Price: $500 USD one-time founding-cohort price, or 2 payments of $275 USD if that payment option is offered at checkout
- Access: 6 months
- Type: Guided implementation program: Sprint plus direct advisory support from Jeff during a limited guided support window
- Capacity: Intentionally limited, currently described as a maximum of 5 new Advisor clients per month. Founding-cohort Advisor pricing is currently available for the first 10 Advisor clients, and Sprint founding-cohort pricing is currently available for the first 50 Sprint users.
Founding-cohort pricing is available to a limited number of early users while PivotDesk builds its next round of case studies. After that cohort is filled, standard pricing applies.
We may change our offers, packaging, and pricing in the future, but changes will not retroactively remove access already purchased except as permitted by law and these Terms.
PivotDesk is sold as a one-time purchase for a defined access period. Unless explicitly stated otherwise at checkout, your purchase does not auto-renew.
All prices are displayed in USD. Displayed prices are intended to be the final price the customer pays, inclusive of any applicable VAT, sales tax, GST, or similar indirect taxes required for that customer’s jurisdiction, as calculated through Stripe Tax or a similar tax engine we use.
That means the customer pays the listed USD amount shown at checkout, applicable taxes are included within that listed amount rather than added on top, and we receive the amount net of applicable taxes and processor fees.
If tax calculation, invoicing, or checkout treatment changes when payment setup is finalized, the live checkout terms will control to the extent they are consistent with applicable law.
We intend to use Stripe for payment processing, including tax calculation and invoicing. Merchant of record: Whimsy OÜ. Billing support contact: [email protected]. We do not store full payment card details ourselves unless explicitly stated otherwise.
If we offer an installment option for Advisor, the installment schedule, due dates, and any payment authorization terms shown at checkout will apply. If an installment payment is missed or reversed, we may suspend Advisor support, suspend access, or cancel the unpaid portion of the service until the balance is resolved.
If you first buy Sprint and are later accepted into Advisor, you may upgrade by paying only the difference between the amount you already paid for Sprint and the then-current Advisor price in effect at the time of upgrade. Upgrade availability is subject to Advisor fit, capacity, and any then-current checkout or payment options we offer.
There is no guaranteed downgrade option once a purchase has been made. If we choose to offer a downgrade, credit, transfer, or other accommodation, we may do so case by case and at our sole discretion.
We may change prices, payment options, or packaging for future customers at any time. Any price change will apply prospectively and will not affect a completed purchase already accepted by us, except where required by law or clearly disclosed in connection with an upgrade or optional add-on.
6. Guarantees, Refunds, and Cancellations
Sprint includes a 14-Day Momentum Guarantee.
If, within the first 14 days, you complete the structured first-week sprint checklist, finish your shortlist, identify at least 10 priority contacts, send at least 10 tailored messages, and schedule follow-ups, but PivotDesk still fails to give you a live, trackable search, you may request a full refund within 7 days after the end of that 14-day period.
This guarantee is meant to reduce the risk of trying the system. It applies only where the buyer actually used the product as intended during that opening period. It does not require that you receive interviews, offers, or employer responses during the first 14 days.
To evaluate a request, we may ask for reasonable information showing that the required work was completed, such as activity history, drafts, outreach records, or a short written explanation. Feedback is welcome but not required.
Advisor includes a 45-Day Traction Guarantee.
If you follow the agreed plan, attend the included sessions, send the agreed outreach volume, and still receive zero qualified replies and zero networking or exploratory conversations within 45 days, your remedy is an extension of guided support by 30 days at no extra charge, including continued draft review and accountability during that extension.
This is a service-extension guarantee, not a refund guarantee. A qualified reply may include interest, a warm redirect, a request for more detail, or openness to a conversation.
Except where required by law or expressly stated in these Terms, all purchases are final, no partial or pro-rated refunds are provided for unused access time, and no refunds are provided because a search takes longer than hoped, because you changed your mind, became busy, accepted another opportunity, or chose not to use the Service, or for unused advisory sessions or missed support opportunities unless we agree otherwise in writing.
Refund or guarantee requests should be sent to [email protected] from the email tied to your account, together with enough information for us to identify your purchase and review the request.
You may stop using PivotDesk at any time. Because PivotDesk is a one-time purchase with a fixed access term, stopping use does not itself create a right to a refund.
7. Advisor-Specific Terms
Advisor is a limited advisory service layered on top of Sprint. It may include a short fit screen, one 30-minute kickoff and positioning session, one target-list and contact-strategy review, two 30-minute advisory sessions, async review of key outreach drafts and follow-ups during the guided support window, and light accountability check-ins.
Advisor is not unlimited coaching, unlimited editing, 24/7 availability, or on-demand response coverage.
Advisor includes 6 weeks of guided support inside the broader 6-month access period. Scheduling, availability, response norms, and rescheduling expectations may be communicated at booking or onboarding.
Both you and PivotDesk are expected to handle scheduling reasonably and in good faith. Occasional rescheduling may happen, but repeated cancellations, repeated no-shows, or failure to participate in scheduled Advisor support may limit our ability to provide the service and may result in unused sessions or support opportunities being forfeited.
Advisor capacity is intentionally limited. We may waitlist, defer, or decline applicants when capacity is full or when the offer is not a good fit.
8. Your Materials and License to Us
You retain ownership of the materials and information you submit to PivotDesk, including notes, drafts, target lists, contact lists, outreach messages, resumes, and related search materials (“Your Materials”).
You grant us a limited, non-exclusive license to host, process, analyze, reproduce, and display Your Materials solely as needed to operate, secure, support, and improve the Service for you.
You represent that you have the necessary rights to submit and use Your Materials and that doing so does not violate law or the rights of others.
9. Acceptable Use
You agree not to use the Service for unlawful, deceptive, discriminatory, or harmful purposes; upload malware or interfere with security or operation; scrape, copy, reverse-engineer, or resell the Service except where law cannot exclude that right; use the Service to send spam or mass unsolicited outreach in violation of law or platform rules; impersonate others or misrepresent your identity or relationship to a company; or use the Service in a way that infringes intellectual property, privacy, or publicity rights.
We may suspend or terminate access if you violate these Terms.
10. Third-Party Services and AI
PivotDesk may rely on third-party providers for hosting, payments, analytics, advertising or remarketing tools, AI features, scheduling, email, and related infrastructure.
We may also provide AI-assisted features to help with drafting, organizing, or analyzing search-related information. AI output can be incomplete, inaccurate, or poorly suited to your situation. You are responsible for reviewing and deciding whether to use any output before acting on it.
We are not responsible for third-party platforms you choose to use in your search, including email providers, LinkedIn, recruiters, applicant-tracking systems, or employer websites.
11. Intellectual Property
PivotDesk and its software, design, templates, frameworks, prompts, branding, and original content are owned by us or our licensors and are protected by intellectual property law.
Subject to these Terms, we give you a limited, non-transferable, non-exclusive right to use the Service and the materials included in your purchased offer for your own internal personal use during the access period.
You may not copy, resell, publish, distribute, or create a competing commercial product from PivotDesk materials unless we expressly allow it in writing.
12. Service Availability and Changes
We aim to keep PivotDesk available and useful, but we do not promise uninterrupted or error-free operation.
We may update, improve, replace, or discontinue features from time to time. If we materially reduce the core paid functionality of the Service during your active access period, we will use reasonable efforts to provide a comparable alternative, extension, credit, or other fair remedy as appropriate under the circumstances and applicable law.
13. Disclaimers
To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will meet every expectation or be uninterrupted or error-free, and we do not guarantee interviews, offers, placements, salary outcomes, employer responses, hiring timelines, or that using PivotDesk will be suitable for every career situation.
You are responsible for your own actions, communications, applications, and professional decisions.
14. Limitation of Liability
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, intentional misconduct, or mandatory consumer rights.
To the maximum extent permitted by law, our total liability arising out of or relating to the Service or these Terms will not exceed the greater of the total amount you paid us for the specific PivotDesk offer giving rise to the claim or EUR 100.
We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost opportunities, loss of goodwill, or loss of data, except where such limitations are prohibited by law.
15. Suspension and Termination
You may stop using the Service at any time.
We may suspend or terminate your access if you violate these Terms, engage in fraud, abuse, or conduct that creates legal or security risk, payment is not completed when due, or we are required to do so by law. Where appropriate, we may first give notice and a chance to cure.
16. Governing Law and Disputes
These Terms are governed by the laws of Estonia, without regard to conflict-of-laws rules.
If a dispute arises, we encourage the parties to try to resolve it informally first by contacting [email protected].
If informal resolution does not work, disputes will be resolved in the courts of Tallinn, Estonia, unless mandatory consumer protection law in your country of residence gives you the right to bring a claim elsewhere.
16.1 Additional terms for U.S. customers
If you are located in the United States, you and PivotDesk agree that disputes arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court where permitted, seek injunctive relief for misuse of intellectual property or unauthorized access, or pursue any claim that cannot lawfully be required to be arbitrated.
Arbitration will be conducted on an individual basis. You and PivotDesk each waive the right to participate in a class action, class arbitration, representative action, or jury trial to the maximum extent permitted by law.
This section does not limit any mandatory consumer protection rights that apply in your country or state of residence, and it does not prevent either party from seeking informal resolution first.
17. Changes to These Terms
We may update these Terms from time to time. If we make a material change, we will post the updated version on the website and may provide additional notice where appropriate.
The updated Terms will apply from the effective date stated in the revised version. If you continue using the Service after that date, you accept the updated Terms.
