1. Introduction

These Terms of Service (“Terms”) govern access to and use of PivotDesk, including the website, software, templates, workflows, and related materials we provide (together, the “Service”).

By purchasing, creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use PivotDesk.

In these Terms, “PivotDesk,” “we,” “us,” and “our” mean Whimsy OÜ, an Estonian company registered under number 17495721.

2. About PivotDesk

PivotDesk is a structured relationship-led job-search system for experienced professionals making a meaningful move that may make more sense in conversation than on paper. Depending on the package you purchase, the Service may include software, structured workflows, company targeting tools, contact prioritisation, CSV import workflows, outreach and follow-up support, tracking tools, preparation workflows, educational materials, and related features.

You remain responsible for your own job search, communications, applications, professional decisions, and use of any third-party services or data sources.

3. Eligibility

To use PivotDesk, you must be at least 18 years old, have the legal capacity to enter into a binding agreement, not be prohibited from using the Service under applicable law, and, if acting for an employer or other organization, have authority to bind that organization to these Terms.

4. Accounts and Access

You may need to create an account to access some or all of the Service. You agree to provide accurate information and keep it current.

You are responsible for maintaining the confidentiality of your login credentials and for activity under your account. Notify us promptly at [email protected] if you believe your account has been accessed without authorization.

Unless we expressly agree otherwise in writing, each purchase is for one individual user’s own search. You may not share your account or distribute paid materials to others.

PivotDesk is a one-time purchase, not a recurring subscription. Each package includes 6 months of access from the date your access is activated.

After your 6-month access period ends, you may continue to view your existing data in PivotDesk for a limited post-access period but may not create new content or make changes within the system. Account and workspace data may later be archived or deleted under our Privacy Policy. Extension options and pricing may be communicated closer to the end of your access period.

5. Offers, Pricing, Payment, and Taxes

Founding pricing is limited and may end separately for each package after the first 50 purchases of that package. We may change offers, packaging, pricing, payment options, or availability for future customers at any time. Changes will not retroactively remove access already purchased except as permitted by law and these Terms.

PivotDesk is sold as a one-time purchase for a defined access period. Unless explicitly stated otherwise at checkout, your purchase does not auto-renew.

All prices are displayed in USD. Displayed prices are intended to be the final price the customer pays, inclusive of any applicable VAT, sales tax, GST, or similar indirect taxes required for that customer’s jurisdiction, as calculated through Stripe Tax or a similar tax engine we use.

That means the customer pays the listed USD amount shown at checkout, applicable taxes are included within that listed amount rather than added on top, and we receive the amount net of applicable taxes and processor fees.

If tax calculation, invoicing, or checkout treatment changes when payment setup is finalized, the live checkout terms will control to the extent they are consistent with applicable law.

We intend to use Stripe for payment processing, including tax calculation and invoicing. Merchant of record: Whimsy OÜ. Billing support contact: [email protected]. We do not store full payment card details ourselves unless explicitly stated otherwise.

If you first purchase Map and later upgrade to Momentum (or Prepared, when it becomes available) within one month of your Map purchase, the amount you paid for Map will be credited against the then-current Momentum price at the time of upgrade. For example, if you paid $25 USD for Map and the current Momentum price at upgrade is $150 USD, the upgrade price is $125 USD.

After one month from the Map purchase date, PivotDesk does not promise an explicit Map-to-Momentum upgrade credit.

There is no guaranteed downgrade option once a purchase has been made. If we choose to offer a downgrade, credit, transfer, or other accommodation, we may do so case by case and at our sole discretion.

6. Guarantees, Refunds, Cancellations, and No Outcome Guarantee

Except where required by law or expressly stated in these Terms, all purchases are final. PivotDesk does not guarantee interviews, employer replies, networking calls, job offers, placement, compensation outcomes, visa outcomes, or hiring timelines.

6.1 7-Day Map Guarantee

Map includes a 7-Day Map Guarantee.

Map is considered delivered when the buyer’s PivotDesk workspace contains: (1) a company universe based on the buyer’s chosen role/function and geography; (2) a prioritised company list from that universe; and (3) a prioritised list of at least 10 suitable contacts, with available contact details, for relationship-led informational interviews.

If the buyer completes the Map checklist within 7 days after Map access begins and one or more of these required outputs is absent, the buyer may request a full refund within 7 days after the end of that 7-day period.

This guarantee is meant to reduce the risk of trying the mapping workflow. It applies only where the buyer actually used Map as intended during that opening period. It does not require that you receive interviews, offers, employer responses, networking conversations, or any other market outcome during the first 7 days.

6.2 14-Day Momentum Guarantee

Momentum includes a 14-Day Momentum Guarantee.

If, within the first 14 days after Momentum access begins, you complete the Momentum checklist — shortlist finished, 10 priority contacts identified, 10 tailored messages sent, and follow-ups scheduled — but PivotDesk still fails to give you a live, trackable search, you may request a full refund within 7 days after the end of that 14-day period.

This guarantee is meant to reduce the risk of trying the full outreach system. It applies only where the buyer actually used Momentum as intended during that opening period. It does not require that you receive interviews, offers, employer responses, networking conversations, or any other market outcome during the first 14 days.

6.3 Review Process and General Refund Terms

To evaluate a guarantee request, we may ask for reasonable information showing that the required work was completed or that the required outputs were absent, such as activity history, target lists, contact lists, drafts, outreach records, follow-up records, or a short written explanation. Feedback is welcome but not required.

Refund or guarantee requests should be sent to [email protected] from the email tied to your account, together with enough information for us to identify your purchase and review the request.

Because PivotDesk is a structured system for the user’s own job search, refunds are not provided in cases where a job search takes longer than hoped, because the user changes direction, becomes busy, chooses not to use the Service, receives no employer response, or does not achieve a desired career outcome.

If PivotDesk materially fails to provide the core paid functionality of the package purchased, or if an external contact-data workflow change materially prevents use of the purchased package and no reasonable alternative workflow is provided, the user may contact [email protected] for review.

You may stop using PivotDesk at any time. Because PivotDesk is a one-time purchase with a fixed access term, stopping use does not itself create a right to a refund.

7. Prepared Availability

Prepared is a productised preparation workflow layered on top of Momentum. When available, it may include workflows for interview preparation, story development, company and interviewer research, practice, and negotiation preparation.

Prepared does not include guaranteed live coaching, direct founder access, unlimited review, unlimited editing, 24/7 availability, recruiting services, placement services, or done-for-you job-search support.

8. Your Materials and License to Us

You retain ownership of the materials and information you submit to PivotDesk, including notes, drafts, target lists, contact lists, outreach messages, resumes, imported CSV data, and related search materials (“Your Materials”).

You grant us a limited, non-exclusive license to host, process, analyze, reproduce, and display Your Materials solely as needed to operate, secure, support, and improve the Service for you.

You represent that you have the necessary rights to submit and use Your Materials and that doing so does not violate law or the rights of others.

9. Acceptable Use

You agree not to use the Service for unlawful, deceptive, discriminatory, or harmful purposes; upload malware or interfere with security or operation; scrape, copy, reverse-engineer, or resell the Service except where law cannot exclude that right; use the Service to send spam or mass unsolicited outreach in violation of law or platform rules; impersonate others or misrepresent your identity or relationship to a company; or use the Service in a way that infringes intellectual property, privacy, or publicity rights.

We may suspend or terminate access if you violate these Terms.

10. Third-Party Services, Contact-Data Tools, and AI

PivotDesk may rely on third-party providers for hosting, payments, analytics, advertising or remarketing tools, AI features, scheduling, email, and related infrastructure.

Some PivotDesk workflows require the user to use an external contact-data tool or account outside PivotDesk. The user is responsible for creating and managing that external account, complying with the external provider’s terms, exporting data lawfully, and importing the resulting CSV or other supported file into PivotDesk.

PivotDesk does not sell, resell, sublicense, or guarantee third-party contact data. PivotDesk provides workflow structure, prioritisation, import support, and next-step guidance around data the user obtains through their own external account.

External tools may change their pricing, limits, availability, export rights, or terms. If a change to an external contact-data workflow materially prevents a purchaser from using the core functionality of the purchased PivotDesk package, PivotDesk will use reasonable efforts to provide a reasonable alternative workflow or refund the affected purchase.

We may also provide AI-assisted features to help with drafting, organizing, or analyzing search-related information. AI output can be incomplete, inaccurate, or poorly suited to your situation. You are responsible for reviewing and deciding whether to use any output before acting on it.

We are not responsible for third-party platforms you choose to use in your search, including email providers, LinkedIn, recruiters, applicant-tracking systems, employer websites, or external contact-data accounts.

11. Intellectual Property

PivotDesk and its software, design, templates, frameworks, prompts, branding, and original content are owned by us or our licensors and are protected by intellectual property law.

Subject to these Terms, we give you a limited, non-transferable, non-exclusive right to use the Service and the materials included in your purchased package for your own internal personal use during the access period.

You may not copy, resell, publish, distribute, or create a competing commercial product from PivotDesk materials unless we expressly allow it in writing.

12. Service Availability and Changes

We aim to keep PivotDesk available and useful, but we do not promise uninterrupted or error-free operation.

We may update, improve, replace, or discontinue features from time to time. If we materially reduce the core paid functionality of the Service during your active access period, we will use reasonable efforts to provide a comparable alternative, extension, credit, or other fair remedy as appropriate under the circumstances and applicable law.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will meet every expectation or be uninterrupted or error-free, and we do not guarantee interviews, offers, placements, salary outcomes, employer responses, hiring timelines, or that using PivotDesk will be suitable for every career situation.

You are responsible for your own actions, communications, applications, and professional decisions.

14. Limitation of Liability

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, intentional misconduct, or mandatory consumer rights.

To the maximum extent permitted by law, our total liability arising out of or relating to the Service or these Terms will not exceed the greater of the total amount you paid us for the specific PivotDesk package giving rise to the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost opportunities, loss of goodwill, or loss of data, except where such limitations are prohibited by law.

15. Suspension and Termination

You may stop using the Service at any time.

We may suspend or terminate your access if you violate these Terms, engage in fraud, abuse, or conduct that creates legal or security risk, payment is not completed when due, or we are required to do so by law. Where appropriate, we may first give notice and a chance to cure.

16. Governing Law and Disputes

These Terms are governed by the laws of Estonia, without regard to conflict-of-laws rules.

If a dispute arises, we encourage the parties to try to resolve it informally first by contacting [email protected].

If informal resolution does not work, disputes will be resolved in the courts of Tallinn, Estonia, unless mandatory consumer protection law in your country of residence gives you the right to bring a claim elsewhere.

16.1 Additional terms for U.S. customers

If you are located in the United States, you and PivotDesk agree that disputes arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court where permitted, seek injunctive relief for misuse of intellectual property or unauthorized access, or pursue any claim that cannot lawfully be required to be arbitrated.

Arbitration will be conducted on an individual basis. You and PivotDesk each waive the right to participate in a class action, class arbitration, representative action, or jury trial to the maximum extent permitted by law.

This section does not limit any mandatory consumer protection rights that apply in your country or state of residence, and it does not prevent either party from seeking informal resolution first.

17. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we will post the updated version on the website and may provide additional notice where appropriate.

The updated Terms will apply from the effective date stated in the revised version. If you continue using the Service after that date, you accept the updated Terms.

19. Package and Refund Interpretation Policy

The PivotDesk package descriptions, limitations, upgrade credits, and refund terms are limited and should be read exactly as stated.

20. AI Usage Notice

PivotDesk may use AI-assisted features to help organize information or generate draft language. These features are intended to support the user, not replace judgment.

Users must review all AI-assisted output before sending messages, contacting employers, or relying on it in professional settings.

PivotDesk may route AI-assisted requests through OpenRouter and supported model providers. Models may vary over time as provider availability, model quality, cost, performance, and reliability change, but will generally include best-in-class models from providers such as Anthropic, OpenAI, and Google Gemini.
